Divorce Proceedings

What is Divorce?
Divorce is the legal process of ending a marriage. In England and Wales, you can now apply for a “no-fault” divorce, meaning you do not have to blame your spouse or prove wrongdoing.

How does the process work?

  1. Application: You or your spouse can apply for a divorce online or by post. You will need your marriage certificate and some basic details.
  2. Acknowledgement: The other spouse is sent the application and must confirm receipt.
  3. Conditional Order: After a 20-week reflection period, you can apply for a conditional order (previously called decree nisi).
  4. Final Order: Six weeks later, you can apply for the final order (previously called decree absolute), which legally ends the marriage.

Key Points

  • You must have been married for at least one year.
  • The process is usually straightforward, especially if both parties agree.
  • Financial and child arrangements are dealt with separately but can run alongside the divorce.
