Protective Orders

What Are Protective Orders?

Protective orders are legal measures designed to keep you safe from an abuser. The most common types are Non-Molestation Orders and Occupation Orders.

Non-Molestation Order

This order prevents someone from using or threatening violence, harassing, intimidating, or pestering you or your children. Breaching a non-molestation order is a criminal offence.

Occupation Order

This order regulates who can live in the family home or enter the surrounding area. It can require the abuser to leave the home, even if they are the legal owner or tenant.

How to Apply

  • Applications can be made urgently, often without the abuser being present (known as “without notice” or ex parte).
  • The court will consider your safety and the welfare of any children.
  • Orders can be granted quickly, sometimes on the same day.
